Five Lakes Studio LLC ("FLS") is a small startup company in a fast moving industry. We care about how we treat you, our customers and supporters (collectively "you"). We also care about providing you with services and products that you find appealing and helpful.
This notice constitutes our privacy policy ("Privacy Policy"). By visiting www.fivelakesstudio.com (the "Website") or by downloading one of our software applications (the "Software"), you are accepting the practices described in this Privacy Policy. This Privacy Policy can be changed by FLS at any time.
If you license a FLS Software application, the terms of this Privacy Policy are incorporated into the terms and conditions of the Software License Agreement (the "Agreement").
If you visit the Website, the terms of this Privacy Policy are incorporated into the terms and conditions of Terms of Use (the "TOU").
The general approach of FLS is to obtain personally identifiable information on an "opt in" basis, and to utilize and share information in ways that FLS believes will benefit you.
a. Obtaining Personally Identifiable Information. As a general matter, FLS takes an "opt in" approach when it comes to your personally identifiable information. Neither our Website nor our Software seeks to obtain personally identifiable information about you unless you expressly consent to the sharing of the information by providing that information to FLS. The Website and our Software do automatically capture information about you that is not personally identifiable information. Some information that is not personally identifiable can become personally identifiable information when linked together with information from other sources.
b. Broad Use of Information. FLS is a small company in a fast moving industry. We leverage 3rd party companies both small and large to help provide a variety of services. Some of these companies include Parse, Weebly, MailChimp, Google, and other online companies. Given our size, FLS cannot fully vet all the companies that we end up using or trying out. We tend to do a lot of different experimentations to try and bring you more services and help us measure how we are doing. We cannot fully delineate all the data these companies may collect and what they may do with this information. So when you provide us with information, you should do so with the understanding that FLS will share such information (whether personally identifiable or not) with third parties as FLS deems appropriate.
a. E-Mail Address. For a variety of reasons, you may provide FLS with your e-mail address. This can be done to subscribe to our newsletter, or to receive other forms of communications or notices from FLS. You may also decide to provide FLS with your e-mail address in order to receive support from FLS or to merely communicate with FLS about what you like or don't like about our Software. FLS reserves the right to utilize and share your e-mail address information with third parties for the purposes of: (i) FLS providing products/services to you through the Website or a Software application; and/or (ii) FLS marketing potential products/services to you that relate to a potential future version of the Website or a future Software application.
b. Mobile Location Data. Some Software applications are designed to capture information about your mobile device and your location. Most mobile devices allow you to turn off such information gathering.
c. Apple ID. If you purchase a license to a Software application by FLS on iTunes or the Apple Store, FLS will obtain your Apple ID as a result of the transaction. FLS reserves the right to utilize and share your Apple ID with third parties for the purposes of: (i) FLS providing products/services to you through the Website or a Software application; and/or (ii) FLS marketing potential products/services to you that relate to a potential future version of the Website or a future Software application.
d. Cookies. FLS receives and stores certain types of information whenever you interact with the Website. For example, like many Web sites, we use "cookies," and we obtain certain types of information when your Web browser accesses the Website or advertisements and other content served by or on behalf of the Website on other Web sites. Disabling the cookies on your computing device may interfere with your ability to take advantage of functionality provided on the Website or a Software application.
FLS may use your information in a variety of ways.
a. Promotional Offers. We may use your information to contact you about promotional offers from FLS or third parties.
b. Providing Functionality Through Third Parties. We may use your information to provide products, services, and functionality to you through a Software application or the Website.
c. Third Party Advertising/Links To Other Websites. FLS reserves the right to include third-party advertising links and links to other websites on the Website or in our Software applications. It is the belief of FLS that you benefit by communications that target your likely interests.
